Terms of Service

These Terms of Service ("Terms"), together with our Privacy Policy, govern your use of the Trusted Tours platform. By accessing or using our website at trustedtours.com or any associated services (collectively, the "Platform"), you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. About Us

Trusted Tours is operated by Trusted Tours, Inc., a Delaware corporation ("Trusted Tours," "we," "us," or "our"). We operate the Platform as an online marketplace that connects independent tour guides and experience providers ("Guides") with customers ("Customers") seeking to book tours, activities, and experiences ("Experiences").

2. Our Role as a Marketplace

2.1 Intermediary Only

Trusted Tours acts solely as an intermediary marketplace. When you book an Experience, the contract for that Experience is formed directly between you and the Guide. Trusted Tours is not a party to that contract and does not provide, operate, or supervise any Experiences.

2.2 Guide Independence

Guides are independent contractors, not employees, agents, or representatives of Trusted Tours. We do not control, direct, or supervise the conduct of any Guide or the content or safety of any Experience. All Experience descriptions, photographs, availability, and pricing are provided and maintained by the respective Guides.

2.3 No Liability for Experiences

Trusted Tours is not responsible or liable for any acts, errors, omissions, representations, warranties, breaches, negligence, or misconduct of any Guide, or for any personal injury, death, property damage, or other loss or expense arising from or related to any Experience.

2.4 Commission

We receive a 3% commission from the Guide for facilitating each booking. The price displayed on the Platform is the total price set by the Guide. This commission is deducted from the Guide's payout and does not increase the price you pay.

3. Accounts

3.1 Account Creation

To book Experiences or list as a Guide, you must create an account. You must provide accurate and complete information and keep your account information up to date.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

3.3 One Account Per Person

You may only create one account. Accounts are non-transferable.

4. Booking and Payment

4.1 Booking

When you select and purchase an Experience, you enter into a binding agreement directly with the Guide who provides that Experience. Trusted Tours facilitates this transaction on behalf of the Guide.

4.2 Payment Processing

Payments are processed through our third-party payment processor, Stripe. By making a payment, you agree to Stripe's terms of service. Your payment is collected on behalf of the Guide. Once payment is successfully processed, you have fulfilled your payment obligation to the Guide.

4.3 Pricing

All prices are set by the Guides and displayed on the Platform. Prices are inclusive of the Guide's fees. Additional local taxes or fees may apply depending on your jurisdiction.

4.4 Payment Information

You must provide truthful payment information and confirm that you are authorized to use the selected payment method.

5. Cancellation and Refunds

5.1 Customer Cancellation Policy

The following cancellation policy applies to all bookings:

  • Cancellation within 24 hours of booking: If you cancel within 24 hours of making your booking, you will receive a full refund, provided that the Experience is not scheduled to begin within that 24-hour window.
  • Booking made less than 24 hours before the Experience: If you book an Experience that is scheduled to begin within 24 hours of the time of booking, no cancellation or refund is available.
  • Cancellation after 24 hours of booking: No refund will be issued for cancellations made more than 24 hours after the booking was placed.

5.2 Guide Cancellation

Guides may cancel an Experience due to circumstances beyond their control, including but not limited to adverse weather, safety concerns, illness, or force majeure events. In such cases, you will receive a full refund of the booking price.

5.3 Refund Method

Refunds will be issued to the original payment method used for the booking. Processing times depend on your payment provider.

6. User Conduct

6.1 Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
  • Post false, misleading, defamatory, or fraudulent content.
  • Use automated systems (bots, scrapers, crawlers) to access or extract data from the Platform without our prior written consent.
  • Commercially resell bookings or Experiences obtained through the Platform.
  • Harass, abuse, or threaten any Guide, Customer, or Trusted Tours personnel.
  • Attempt to circumvent the Platform to transact directly with Guides to avoid Platform fees.
  • Impersonate any person or entity or misrepresent your identity.

6.2 Account Suspension

We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms, engaged in fraud, or posed a risk to other users or the Platform.

7. Reviews and User Content

7.1 Reviews

You may post reviews for Experiences you have completed. Reviews must be honest, accurate, and based on your personal experience. Reviews that are fraudulent, incentivized by a Guide, defamatory, or that violate the rights of others are prohibited.

7.2 License to User Content

By posting content on the Platform (including reviews, photos, and other materials), you grant Trusted Tours a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, display, and distribute that content in connection with operating and promoting the Platform.

7.3 Content Removal

We may remove any user content at our sole discretion, including content that violates these Terms or that we deem inappropriate.

8. Intellectual Property

The Platform, including its design, text, graphics, logos, icons, and software, is the property of Trusted Tours or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our express written consent.

9. Disclaimer of Warranties

THE PLATFORM AND ALL CONTENT, SERVICES, AND EXPERIENCES ACCESSIBLE THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TRUSTED TOURS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY EXPERIENCE DESCRIPTIONS, PRICING, OR OTHER CONTENT PROVIDED BY GUIDES.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRUSTED TOURS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM OR ANY EXPERIENCE, HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF LIABILITY.

IF TRUSTED TOURS IS FOUND LIABLE FOR ANY LOSS OR DAMAGE, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TRUSTED TOURS IN CONNECTION WITH THE BOOKING GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS (US $100.00).

WE ARE NOT LIABLE FOR ANY ACTS OR OMISSIONS OF ANY GUIDE OR FOR ANY INJURY, DEATH, PROPERTY DAMAGE, OR OTHER LOSS ARISING FROM OR RELATED TO ANY EXPERIENCE.

11. Indemnification

You agree to defend, indemnify, and hold harmless Trusted Tours and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Platform or participation in any Experience.
  • Your violation of these Terms.
  • Your violation of any applicable law or regulation.
  • Your violation or infringement of the rights of any third party.
  • Any content you post or submit through the Platform.

12. Dispute Resolution and Arbitration

12.1 Informal Resolution

Before filing any formal proceeding, you agree to first contact us and attempt to resolve the dispute informally. You must send a written description of your claim to us via our contact page. We will attempt to resolve the dispute within 60 days. If the dispute is not resolved within 60 days, either party may proceed as set forth below.

12.2 Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, or any Experience booked through the Platform (collectively, "Claims") shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration shall be conducted by one neutral arbitrator, in English, and the seat of arbitration shall be Wilmington, Delaware.

The arbitrator may award only those damages permitted under these Terms, subject to the limitations of liability set forth herein. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

12.3 Opt-Out

You may opt out of binding arbitration by sending a written notice to Trusted Tours within 30 calendar days of first using the Platform. The opt-out notice must be sent by mail to: Trusted Tours, Inc., Attn: Legal Department, [Address]. If you do not opt out within 30 days, you are bound by this arbitration provision.

12.4 Class Action Waiver

YOU AND TRUSTED TOURS AGREE THAT ANY PROCEEDINGS, WHETHER IN ARBITRATION OR IN COURT, SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. BOTH PARTIES WAIVE THE RIGHT TO A JURY TRIAL. If a court or arbitrator determines that this class action waiver is unenforceable, this arbitration section shall not apply to you.

12.5 Exceptions

The following claims are not subject to binding arbitration and may be brought in court: (i) claims of intellectual property infringement, (ii) claims seeking emergency injunctive relief, and (iii) small claims court actions.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Delaware.

14. Termination

14.1 By You

You may terminate your account at any time by contacting us or through your account settings. Termination does not affect any existing bookings that have already been confirmed.

14.2 By Us

We may suspend or terminate your account or access to the Platform at any time, with or without cause, upon reasonable notice. If we terminate your account, any confirmed bookings will be honored or refunded at our discretion.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Effective Date" above. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any Guide-specific terms, constitute the entire agreement between you and Trusted Tours regarding your use of the Platform and supersede any prior agreements.
